The Ins and Outs of Busting a Bad Cop

The sentencing of former Milwaukee police officer on corruption charges when he took $1,000 in a sting operation was finally handed down. Royce Lockett will have to serve two years in prison for the crime. If that seems lenient, and maybe they gave him a break because he was a police officer – think again.

Federal crimes with minimum sentencing have a loophole built in. First time offenders, or those who only commit a single crime, don’t face the harsh sentences. In fact, if Lockett hadn’t been a police officer, it is likely he would have gotten no jail time at all. The sentencing judge specifically said the prison sentence was meant to convey a “no tolerance” policy for those who wear the badge.

So, in this case, being a cop meant more time instead of less. But what about arresting him in a sting in the first place? He though he was facilitating the delivery of cocaine and money, but the cocaine was fake and the money marked. In fact, the drug dealer in question was a federal informant.

The sting rules work like this: you can present an opportunity the target might not have normally, but they have to take the bait. It’s OK to tempt, but not coerce. It doesn’t matter if ex-officer Lockett thought he was just doing a favor for a friend and the whole thing was a setup. He did it and he took the money. Case closed.

Lockett had been a police officer for two years when the sting went down. The arrest was two years ago as well. And now, he’s got two years in the pen.
